This Privacy Policy (the “Policy”) explains what information we collect through the Site, how we use and disclose it, the choices and rights available to you, and how we protect it. The Site is also governed by our Terms & Conditions at https://duchateau.com/terms-conditions, which are incorporated by reference.

This Policy applies to personal information we collect through the Site. It does not apply to information collected offline or through channels other than the Site.

Please read this Policy carefully. By clicking “I Agree” (or the equivalent affirmative button) when prompted, and as otherwise permitted by applicable law, you acknowledge that you have read and understood this Policy and consent to the collection, use, and disclosure of your information as described here — including the use of cookies, pixels, and similar technologies and the transmission of certain information to the analytics and advertising providers identified below.

1. Information We Collect

Categories of personal information. In the preceding 12 months, we have collected the following categories of personal information (using the categories set out in the California Consumer Privacy Act, Cal. Civ. Code § 1798.140):

• Identifiers — name, postal address, email address, telephone number, IP address, and online/device identifiers.
• Customer records / commercial information — products or services purchased or considered, order and warranty-registration information, and payment information you provide to complete a transaction.
• Internet or other electronic network activity — browsing and interaction data on the Site, the referring website, browser type, pages viewed, and search terms entered (clickstream data).
• Geolocation data — approximate location derived from IP address or, where enabled, location-based services.
• Professional or employment information — where you apply for employment, your job interests, background, and résumé information.
• Inferences — preferences and characteristics derived from the above to personalize content and offerings.

Sensitive personal information. We do not collect or use sensitive personal information (as defined in Cal. Civ. Code § 1798.140(ae)) for purposes other than those permitted without a right to limit.

Sources. We collect this information directly from you (e.g., forms, account registration, purchases, warranty registration, employment applications), automatically through your interaction with the Site (cookies and similar technologies), and from third-party analytics and advertising providers and data-enhancement vendors.

Children. The Site is directed to persons at least sixteen (16) years of age. We do not knowingly collect personal information from anyone under 16. If you believe a child under 16 has provided us information, contact us at the address below and we will promptly delete it. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

2. How We Use Information

We use personal information to: fulfill orders and requests for products, services, and information; create and manage accounts; process warranty registrations and employment applications; personalize your experience and recommend products; measure and improve the Site, our marketing, and our products and services; conduct analytics; deliver advertising, including interest-based advertising; administer promotions and surveys; provide customer service; prevent fraud and protect security; and comply with legal obligations. We do not use automated decision-making that produces legal or similarly significant effects concerning you.

3. Cookies and Tracking Technologies

We and our third-party providers use cookies, pixels/web beacons, software development kits, and similar technologies on the Site to enable functionality, remember your preferences, measure Site performance, conduct analytics, and deliver and measure advertising. These technologies, including those operated by the third-party analytics and advertising providers identified below, may collect information about your device and your activity on the Site (including IP address, device identifiers, pages viewed, and interactions) and transmit that information to those providers.

The third-party providers whose technologies are or may be active on the Site include:

• Google — Google Analytics, Google Tag Manager, Google Ads/DoubleClick, and Google Signals.
• Meta — the Meta Pixel and related advertising tools.
• Shopify— Shopify Analytics Tracker.

Your choices.

• Consent and cookie preferences. When you first visit the Site you will be presented with a consent prompt that lets you accept or decline non-essential cookies and tracking technologies and manage your preferences. You may change your choices at any time through the “Cookie Preferences” / “Privacy Choices” link available on the Site.
• Google Analytics. You may opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout and manage Google ad personalization at https://myadcenter.google.com/ and https://myactivity.google.com/.
• Interest-based advertising. You may opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at http://optout.aboutads.info/ and the Network Advertising Initiative at https://optout.networkadvertising.org/.
• Opt-out preference signals (Global Privacy Control). We recognize and honor the Global Privacy Control (GPC) and other opt-out preference signals as a valid request to opt out of the sale/sharing of personal information for the browser or device that sends the signal.

4. How We Disclose Information

We disclose personal information to: service providers and contractors who perform functions on our behalf (e.g., hosting, payment processing, order fulfillment, analytics, marketing, IT); the analytics and advertising providers described in Section 3; and other parties with your direction or consent. We may also disclose information (a) to comply with law or respond to lawful requests and legal process; (b) to protect our rights, property, or safety, or that of others, and to investigate fraud; and (c) in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which personal information may be transferred as a business asset.

“Sale” and “sharing” under California law. DUCHATEAU does not sell your personal information for money. However, our use of third-party analytics and advertising technologies (Section 3) may constitute “sharing” for cross-context behavioral advertising, and may constitute a “sale,” as those terms are defined in Cal. Civ. Code §1798.140. You have the right to opt out — see Section 6 and the “Do Not Sell or Share My Personal Information” link on the Site.

We disclose personal information to service providers and contractors for business purposes including the operational purposes described in Section 2.

5. Data Retention

We retain each category of personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Site and our services, maintain your account and order history, comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it. We do not retain personal information longer than reasonably necessary for the disclosed purpose for which it was collected.

6. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights regarding your personal information:

• Right to know / access — to request the categories and specific pieces of personal information we have collected, the categories of sources, the business or commercial purposes for collecting, selling, or sharing it, and the categories of third parties to whom we disclose it.
• Right to delete — to request deletion of personal information we collected from you, subject to legal exceptions.
• Right to correct — to request correction of inaccurate personal information.
• Right to opt out of sale/sharing — to direct us not to sell or share your personal information.
• Right to limit use of sensitive personal information — to the extent we use sensitive personal information beyond permitted purposes.
• Right to non-discrimination — we will not discriminate or retaliate against you for exercising these rights.

How to exercise your rights. Submit a request by emailing legal@duchateau.com, or by calling 1-888-382-4283. To opt out of sale/sharing, use the “Do Not Sell or Share My Personal Information“ link on the Site, or send a Global Privacy Control signal. We will verify your identity before responding to a request to know, delete, or correct, and we may ask you to provide information sufficient to verify your identity. You may use an authorized agent to submit a request on your behalf, subject to verification. We will not require you to create an account to submit an opt-out request, and if you opt out we will wait at least 12 months before asking you to opt back in.

Shine the Light (Cal. Civ. Code § 1798.83). California residents may request information about the categories of personal information (if any) we disclosed to third parties for those third parties’ direct-marketing purposes in the preceding calendar year, and the identities of those third parties. Submit such requests to legal@duchateau.com.

7. Other Rights

Depending on your jurisdiction, you may also have rights to access, correct, delete, restrict or object to processing, withdraw consent, and data portability, and to lodge a complaint with a supervisory authority. To exercise any such right, contact us using the information below.

8. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access, and we require our service providers to do the same. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Third-Party Sites and Social Media

The Site may link to, or incorporate features from, websites and social-media platforms we do not operate. We are not responsible for the privacy practices of those third parties, and we encourage you to review their policies.

10. Cross-Border Data Transfers

Our systems are located in the United States. If you access the Site from outside the United States, your personal information will be processed in the United States, where data-protection laws may differ from those of your jurisdiction. Where permitted by applicable law, by using the Site you consent to this transfer.

11. Changes to This Policy

We will post the most recent version of this Policy on this page and update the “Last Updated” date. We review and update this Policy at least every 12 months. Material changes may be communicated by additional means, such as email or an on-Site notice, and where required we will obtain your consent.
